An accepted offer should be a significant step towards moving home. Too often, it becomes the start of months of uncertainty, unexpected costs and, sometimes, a collapsed sale.
The scale of the problem is considerable. In February 2025, the Government cited an older estimate of more than 300,000 failed property transactions annually across the UK. Why Do Property Sales Fall Through?
Transactions can fail for several reasons:
- Buyers’ or sellers’ circumstances change, or they reconsider their plans.
- Surveys reveal defects or concerns that lead to withdrawal or unsuccessful renegotiation.
- Mortgage applications, lender valuations or other funding arrangements cause difficulties.
- Legal complications, slow responses or poor coordination delay progress.
- Property particulars contain inaccurate or incomplete information.
- Service charges or proposed major works emerge late in the process.
- Prolonged uncertainty undermines confidence or causes a chain to break.
Some problems cannot be predicted. Others can be identified and addressed before a property goes on the market.
A survey finding, for example, does not automatically mean a sale must fail. Understanding the issue, obtaining appropriate advice and allowing time for an informed discussion can make a substantial difference. Having an experienced agent with development or building experience is vitally important.
Why Early Preparation Matters

Your Questions Answered: How to Prepare for a Smoother Sale
When should I instruct my solicitor?
Instruct your solicitor at the same time as your estate agent, ideally before marketing begins. Complete their identity checks, return their signed terms and pay any required initial funds promptly. This allows onboarding and preparation to take place while you are finding a buyer.
What should I check with my mortgage lender?
Ask for an indication of your outstanding mortgage balance and any early repayment charges. This helps establish what funds will be available after the sale. Your solicitor will obtain a formal redemption statement for the repayment of your mortgage as completion approaches.
What should I prepare if I am selling a leasehold flat?
Contact your managing agent or freeholder early to establish the cost and turnaround time for the management information pack. Discuss with your solicitor when to order it.
Gather your lease, service charge accounts, current budget, ground rent information and relevant correspondence. Flag any disputes, arrears or proposed works at the outset.
Should I disclose service charges and Section 20 works before accepting an offer?
Provide your agent and solicitor with accurate service charge information and details of any known proposed major works, including Section 20 consultation notices and available cost estimates.
Giving buyers this information early helps them assess affordability and reduces the risk of an unexpected bill undermining the transaction later. Make clear where costs remain provisional or have not yet been confirmed.
Do I need buildings insurance documents?
Have your current buildings insurance policy or schedule available for your solicitor. If you own a leasehold flat, the freeholder or managing agent may arrange insurance for the building, so request the relevant details from them.
What documents should I gather for alterations or building work?
Collect relevant planning permissions, building regulations completion certificates, freeholder consents, guarantees and warranties. These may relate to extensions, loft conversions, structural changes, replacement windows or other improvements.
Tell your solicitor promptly if anything is missing. Seek their advice before approaching the council or other parties for retrospective approvals.
Which legal forms can I complete in advance?

Complete them carefully, avoid guessing and raise any uncertainties with your solicitor. Your estate agent can help coordinate preparation, but your solicitor should guide you on the legal responses.
Can preparation guarantee that my sale will complete?
No agent or solicitor can remove every risk. However, accurate information, a properly assessed buyer, early preparation and proactive communication can reduce avoidable delays and give your transaction a stronger foundation. Transparency is the key.
